This study conducts a doctrinal analysis of law enforcement functions and the right to fair trial, in the context of the constitutional duty and administrative obligation of the State to facilitate justice. References are made to statutory and treaty provisions guaranteeing the rights of accused persons, in the context of cases, and comments on the issue, aimed at exposing the state of affairs in various administration of justice systems, including that of Nigeria, Libya, Spain, and others, in the context of cases cited in this study. This research identifies issues and problems bedeviling the right to fair trial and the administration of justice process, including: abuse of authority; the centralization of power; executive interference in the affairs of the judiciary; the denial of the right to appeal; and miscarriage of justice. Thus reiterating the fact that the primary responsibility of the administration of the justice system is to actualize justice. On that account, procedural rules must be applied in a manner that facilitates justice and respect for the rights of accused persons. Also, qualitative justice can only be actualized when the facts and evidence proffered to the court are adequately considered, and necessary orders are given to prevent miscarriage of justice, which occurs when judgment is given contrary to, or without due regard to, vital/material evidence.
